Terms of Service

These Terms govern your use of Ask Poppy (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1) Eligibility

  • You must be at least 13 years old to use the Service. By creating an account, you confirm you are 13 or older. If you are under the age of legal adulthood in your region, review these Terms with a parent or guardian to ensure you understand them.
  • If we learn that someone under 13 is using the Service, we will suspend the account and delete personal data as required by law.

2) Your Account

  • You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account.
  • If you believe your account is compromised, notify us immediately at simon@askpoppy.ai.

3) Acceptable Use

  • Do not use the Service to break the law, infringe rights, harass others, distribute malware, or attempt to disrupt or overload our systems.
  • Do not upload sensitive personal data. If you choose to share personal data, you do so at your own risk and in line with our Privacy Policy.

4) Your Content and AI Outputs

  • You retain ownership of content you submit. You grant us the rights necessary to operate the Service (e.g., to process content for AI responses or voice features).
  • AI outputs may be incorrect, incomplete, or inappropriate for certain uses. Use judgment and independently verify important information.

5) Third‑Party Services

  • We use third‑party providers to deliver parts of the Service, including Clerk (authentication), Cloudflare (hosting/edge), OpenAI (AI text), ElevenLabs (speech), Resend (email), and analytics (PostHog EU and Google Analytics). Their terms and privacy policies apply to their services.
  • ElevenLabs and certain other providers are based in the United States; use of voice features may involve international data transfers. See the Privacy Policy for details.

6) Beta; Changes to the Service

  • The Service may change and may be unavailable at times. We may add, change, or remove features at any time.

7) Intellectual Property

  • We (and our licensors) own the Service and its content (excluding your content). These Terms do not transfer any intellectual property to you.

8) Disclaimers

  • The Service is provided “as is” and “as available,” without warranties of any kind. We do not warrant that the Service will be uninterrupted, secure, or error‑free, or that AI outputs will be accurate or suitable for a particular purpose.

9) Limitation of Liability

  • To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.

10) Indemnification

  • You agree to defend, indemnify, and hold harmless Ask Poppy from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or violation of these Terms.

11) Suspension and Termination

  • We may suspend or terminate your access if you violate these Terms or if needed to protect the Service or other users. You may stop using the Service at any time. Upon termination, certain sections (e.g., IP, disclaimers, limitations) will survive.

12) Governing Terms; Changes

  • We may update these Terms from time to time. When we make material changes, we will notify you in‑app or by email where appropriate. Your continued use after changes take effect constitutes acceptance of the updated Terms.

13) Governing Law and Jurisdiction

  • These Terms are governed by the laws of Norway. Any disputes arising out of or in connection with the Service will be subject to the exclusive jurisdiction of the courts of Norway.

6A) Use of Content for Improvements and Model Training

  • To operate and improve the Service, we process your conversations and related usage data to develop, test, and enhance our models and features. We apply measures to minimize personal data, including de‑identification and filtering of obvious sensitive fields. We do not sell personal data and do not permit our providers to use your data to train their models for their own purposes unless expressly stated in our Privacy Policy.
  • Where required by law, you may object to this processing. See the Privacy Policy for how to exercise your rights. Education/minor accounts may be limited or excluded from training use.
